Terms & Conditions

Both parties have agreed with full legal capacity as follows: –

  1. The above introduction is an integral part of this agreement. It shall be read as a whole, together with the body of the text and any other sections that may have been inserted by this clause to form a single contract.
  2. By signing this reservation form, the Seller hereby confirms and undertakes that he is the current owner of the property or his legal representative under legal power of attorney duly authorized by the competent authorities.
  3. For a period of Fifteen (15) calendar days from the date of signing this Reservation form the purchaser shall be entitled not to proceed in the purchase of the Property and may terminate this Reservation form at its sole discretion and without the requirement to provide details for the reason to terminate, subject to informing the seller within the 15 days period in writing, and in such event the purchaser is entitled to be refunded the reservation price within Fifteen(15) calendar days from the date of termination.
  4. In the event of the termination of the reservation agreement by the purchaser after 15 days, he shall not be entitled to any refund and the seller is allowed to confiscate the reservation price paid by the purchaser.
  5. The Purchaser agrees and acknowledges that the information it has provided in this Reservation Form is complete and accurate and the Purchaser can be contacted by way of the contact details provided.
  6. The Purchaser is entering into a legally binding agreement with the Seller for the purchase of the Property in accordance with the terms of this Reservation Form.
  7. This Reservation Form shall constitute a binding and enforceable initial contract on the Purchaser for the purchase of the Property, a copy of which has been made available to the Purchaser for review and inspection prior to the signing of this Reservation Form.
  8. The Purchaser hereby confirms that its payment obligations under this Reservation Form is not subject to its ability to secure a mortgage loan or financing.
  9. The Seller undertakes to provide all documents proving that he is the current owner of the property, also the Seller undertakes to complete all procedures and requirements to transfer the property to the Buyer’s name immediately after taking possession of the agreed price under this reservation form.
  10. In the event both Buyer and Seller are ready, willing, and able to transfer but transfer cannot take place by transfer date due to a delay by a third party (including but not limited to Bank, Developer or LandDepartment), this reservation form will automatically be extended for fifteen calendar (15) days (“Extension Period”)
  11. Any amendment extension of the deadline dates hereof shall be carried out by the mutual agreement of both parties in writing and signed by each of them.
  12. The Purchaser agrees to pay all pre-registration and/or final registration fees including the Registration Fees and charges of the Ajman Land Department (in addition to the Purchase Price) and shall pay such fees and charges immediately upon request of the Seller (and without any delay). The pre-registration and/or final registration fees including the Registration Fees may be changed by the Ajman Land Department from time to time, and the Purchaser agrees and acknowledges to pay all such additional or amended fees.
  13. The Purchaser acknowledges that the Purchase Price as well as the unit area are approximate and not final and shall be finalized in detail in the SPA.
  14. All payments made by the Purchaser pursuant to this Reservation Form shall be paid in United Arab Emirates Dirhams (AED), being the lawful currency of the UAE. In the event that any payment is made in another currency, the credit to the Purchaser account will be given based on the amount received by the Seller. Any shortfall/surplus due to exchange rate differences shall be recovered/adjusted towards the next installment payment (where applicable).
  15. The Purchaser undertakes that any and all payments made under or pursuant to this reservation Form (regardless of how they are made) are paid by funds of legitimate source and that such funds are not the proceeds of any crime or illegal activity.
  16. Any amounts payable under this Reservation Form are exclusive of VAT and the Purchaser shall pay to the Seller on demand any applicable VAT without delay, if applicable.
  17. This agreement is governed by and shall be construed in accordance with the local and federal laws applicable within the Emirate of Ajman.
  18. Any dispute arising in connection with this reservation form, or its interpretation shall be resolved amicably between the parties within (7) seven days from the date of notification by one party to the other regarding the dispute, in the case if the parties unable to reach an amicable solution, the dispute shall be referred to the competent courts in the Emirate of Ajman. The address of each party in this agreement will be considered as his official address in this regard.
  19. By signing this reservation form, both parties approve that they agreed to all its terms and conditions.
  20. The parties have signed this reservation form, and its provisions shall be enforced once it’s signed by both parties,
  21. Upon cancellation of the unit reservation, the Client acknowledges and agrees that the refund amount deposited in the escrow account shall be subject to all applicable administrative, escrow, and governmental fees required to process the refund. Such fees, including the escrow refund processing fee, shall be deducted from the refund amount prior to payment to the Client.

Disclaimer – Pricing, Availability, Visuals & Timelines

All information provided is indicative and subject to change.

1. Pricing

All prices, price ranges, payment plans, discounts, incentives, service charges, registration fees, DLD fees, and any other financial figures quoted in marketing materials, brochures, websites, presentations, advertisements, or verbal communications are indicative only and subject to change without prior notice. Final prices are those stated in the official sales agreement signed by both parties and registered with the relevant authorities (Ajman Real Estate Regulatory Agency – ARRA). Prices may vary due to unit size, floor level, view, orientation, configuration, market conditions, regulatory changes, or other factors.

2. Availability

Unit availability, specific unit numbers, floor levels, and configurations shown or referenced are subject to prior sale, reservation, or allocation. No unit is reserved or secured until a formal reservation agreement is signed, the required deposit is paid, and the reservation is acknowledged in writing by Aqaar.  Aqaar reserves the right to withdraw, reallocate, or modify the availability of any unit at any time prior to the execution of a binding sale agreement.

3. Visuals, Renders, Images & Representations

All images, photographs, computer-generated renders, 3D visualizations, artist impressions, virtual tours, floor plans, elevations, interior/exterior views, landscaping, furniture, fittings, fixtures, and lifestyle depictions are for illustrative and marketing purposes only. They do not constitute a contractual representation or warranty of the final product. 

The actual completed development may differ in design, materials, finishes, colors, dimensions, layout, landscaping, views, surrounding environment, and other features due to design evolution, site conditions, material availability, regulatory approvals, construction requirements, or other factors. 

Furniture, decorative items, appliances, and fittings shown are not included unless explicitly stated in the sale agreement.

4. Timelines & Completion Dates

All projected handover dates, construction milestones, completion timelines, and possession dates are estimated and provided in good faith based on current plans. 

They are not guaranteed and may be delayed due to unforeseen circumstances including, but not limited to: 

  • Delays in obtaining regulatory approvals or permits
  • Changes in design or specifications
  • Weather conditions
  • Supply chain issues or material shortages
  • Labor availability
  • Force majeure events
  • Instructions or requirements from government authorities

Aqaar shall not be liable for any loss, damage, or inconvenience arising from any delay in handover or completion. Final dates and timelines are those stated in the official sales agreement signed by both parties and registered with the relevant authorities (Ajman Real Estate Regulatory Agency – ARRA).

5. No Contractual Obligation

Nothing contained in any marketing material, website content, brochure, presentation, email, advertisement, social media post, or verbal discussion shall constitute a legally binding offer, representation, or warranty. 

The only binding terms and conditions are those set out in the formal reservation agreement and/or sale & purchase agreement executed between the buyer and Aqaar and, where applicable, registered with the relevant authorities.

6. Buyer Due Diligence

Prospective buyers are strongly advised to: 

  • Conduct their own independent verification of all project details, specifications, approvals, and timelines
  • Review all official project documents, including the ARRA-approved master plan, permit, and unified sale contract
  • Seek independent legal, financial, and technical advice before making any commitment or payment

Aqaar – Ajman Properties Corporation reserves the right to amend, modify, or update any information at any time without prior notice, subject to compliance with applicable laws and regulations.

Important Notice Regarding Residency and Golden Visa Eligibility

Any statements, representations, or references made by Aqaar – Ajman Properties Corporation (or its representatives, agents, marketing materials, website, brochures, presentations, or advertisements) regarding the potential eligibility of a property purchase for a UAE residency visa, Golden Visa, long-term residency, or any other immigration-related benefit are illustrative only and not guaranteed.

Key Points:

1. Government Approval Required

The granting of any UAE residency visa, including the Golden Visa (10-year renewable residency), 5-year residency, or any other visa category, is solely at the discretion of the relevant UAE federal and emirate authorities (including but not limited to the General Directorate of Residency and Foreigners Affairs – GDRFA, Federal Authority for Identity, Citizenship, Customs & Port Security – ICP, and relevant emirate-level entities).

2. No Guarantee

Purchasing a property from Aqaar, including any off-plan or completed project, does not automatically entitle the buyer, investor, or their dependents to residency visa approval or issuance. Eligibility criteria, minimum investment thresholds, qualifying property types, documentation requirements, and approval processes are determined and may be changed at any time by the UAE government.

3. Current Rules Subject to Change

As of the date of this disclaimer, certain real estate investments may qualify under specific Golden Visa categories (e.g., property investment of AED 2 million or more in freehold areas). However, these rules are subject to amendment, suspension, or cancellation without prior notice. Aqaar is not responsible for any changes in UAE immigration or residency laws, regulations, or policies.

4. Independent Verification Advised

Prospective buyers and investors are strongly encouraged to:

  • Verify current Golden Visa / residency visa eligibility requirements directly with official UAE government sources (e.g., ICP website, GDRFA).
  • Consult qualified immigration lawyers, visa consultants, or official government service centers before making any investment decision.
  • Not rely solely on information provided by the developer, brokers, or marketing materials.

5. No Liability

Aqaar – Ajman Properties Corporation, its affiliates, employees, agents, and representatives shall not be held liable or responsible for:

  • Any visa refusal, delay, or revocation.
  • Any changes in immigration laws or policies.
  • Any costs, losses, or consequences arising from reliance on statements related to residency or visa eligibility.

Off-Plan Sales Disclaimer for Aqaar – Ajman Properties Corporation

This disclaimer is intended for use in marketing materials, website pages, brochures, advertisements, social media posts, and sales agreements related to off-plan real estate projects developed or marketed by Aqaar (Ajman Properties Corporation) in the Emirate of Ajman, UAE.

Important Notice – Off-Plan Property Sales

1. Project Status

The properties and projects described are off-plan (sold on the map / under construction / not yet completed). The information, images, renders, floor plans, 3D visuals, specifications, completion dates, payment plans, and other details presented are for illustrative and marketing purposes only. They represent the developer’s current vision and intended design at the time of publication.

2. No Guarantee of Final Product

Actual specifications, finishes, layouts, materials, amenities, views, sizes, and completion timelines may differ from those shown due to design changes, regulatory approvals, construction requirements, market conditions, or other factors beyond the developer’s control. The final product is subject to approval by the Ajman Real Estate Regulatory Agency (ARRA) and other competent authorities.

3. Regulatory Compliance

All off-plan sales are subject to obtaining the necessary sale permit from the Ajman Real Estate Regulatory Agency (ARRA) / Department of Land and Real Estate Regulation – Ajman, in accordance with Law No. 2 of 2020 regulating real estate development in the Emirate of Ajman (and any amendments or implementing regulations). 

No sale, reservation, or binding agreement shall be valid or enforceable until the project is duly registered and the required permits are issued. All payments must be made into a designated escrow account (if required under applicable regulations) and in compliance with ARRA rules.

4. Investment & Financial Disclaimer

Any statements regarding potential rental yields, capital appreciation, return on investment (ROI), residency visa eligibility, or future value are estimates only and not guaranteed. Real estate investments involve risks, including but not limited to market fluctuations, delays in construction, changes in laws, economic conditions, and force majeure events. 5. Buyer Responsibility

Prospective buyers are strongly advised to:

8. Governing Law & Jurisdiction

Any disputes arising from or related to off-plan purchases shall be governed by the laws of the Emirate of Ajman and the United Arab Emirates, with exclusive jurisdiction in the courts of Ajman.

ARRA / Official Verification

Buyers are encouraged to verify project status, developer licenses, and permits directly via the official ARRA portal (ajmanre.gov.ae) or by contacting the Department of Land and Real Estate Regulation – Ajman.

This disclaimer complies with the principles of transparency and buyer protection under Ajman real estate regulations (Law No. 2/2020 and related ARRA guidelines) and aligns with best practices in the UAE real estate sector.

The Dusit Brand is licensed only for the duration of the Agreement and may be withdrawn or terminated in accordance with its terms.

Neither Dusit nor its affiliates have participated in, or is responsible for, the development, construction, offering, or sale of the Residences. AQAAR bears sole and exclusive responsibility for the development, construction, sales, marketing, and all commercial terms related to the Residences, including any financial representations made to purchasers or investors.

The use of the Dusit Brand does not create or imply any partnership, agency, or joint venture between Dusit and AQAAR or any purchaser and shall not be construed as Dusit endorsing or guaranteeing any aspect of the Branded Residences Project.

Marketing & Communication Consent

Sources of Funds & Anti-Money Laundering Declaration

The Purchaser hereby irrevocably undertakes, represents, and warrants that:

  1. The reservation payment and any subsequent payments made in connection with this property purchase are derived from legitimate, lawful, and verified sources of funds, and are not connected, directly or indirectly, to any unlawful, suspicious, or money-laundering activity, as defined under the applicable laws and regulations of the United Arab Emirates.
  2. The Purchaser agrees to provide all supporting documents and financial declarations as may be requested by AQAAR or any competent authority to verify the legitimacy of the funds,“The Purchaser authorizes AQAAR to verify the validity of the identification documents and source of funds and to share information with competent authorities solely for AML/CTF compliance. All personal data shall be kept confidential in accordance with Federal Decree Law 45 of 2021.”
  3. The Purchaser acknowledges that AQAAR shall not be held liable for any claim, penalty, or proceeding arising from the Purchaser’s failure to comply with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) laws.
  4. AQAAR reserves the right to suspend, reject, or terminate the reservation and any related agreements if any payment is suspected or proven to be linked to illicit or unverified sources.

This undertaking shall survive the completion or termination of this reservation and shall always remain binding upon the Purchaser.

In witness whereof the parties have caused this Reservation Form to be executed by their respective duly authorized representatives as of the date first written above, “Both Parties confirm that this transaction complies with the provisions of Ajman Law No. 2 of 2020 and the applicable regulations of the Ajman’s Department of Land and Real Estate Regulation”
